HIPAA stands for the Health Insurance Portability and Accountability Act enacted in 1996. In addition to addressing insurability of preexisting conditions and the continuation of health insurance coverage for individuals changing employers. This law is easily the most comprehenisve heatlh care law ever created. Any company in any way affiliated with the medical industry will be affected at some point. Will EMR systems be Mandatory?

I just had this thought, I just don’t see them becoming mandatory. Its one of those things that would make privacy groups and HIPAA regulators go nuts about. The government getting involved with the electronic record keeping methods of hundreds of private companys.

One thing I can see happening is giving the EMR companys and the providers such large insentives it will be impossible to not make the jump to EMR Systems.

Privacy still a huge concern

The story of the internet has always been, Man creates technology, hacker figures it out and causes problems. With Medical records and the health of many people at steak. The industry can’t afford to relax any regulations regarding privacy.

“We will make the immediate investments necessary to ensure that within five years all of America’s medical records are computerized.” Barack Obama

That’s a monumental task, one that won’t come quick or easy. We can only hope that the push to put everything online Isn’t compromising privacy or technology.

The HIPPA Act is a step in the right direction, but from what I’ve seen, they have a long ways to go as far as actual regulation is concerned.

It’s now the law, your EMR must be E-RX certfied and meet the following qualifications

Allscripts as long ago as 2006 won an award for the most complete E-RX soloution. Today the laws and requirements are much tighter? Does your EMR make the cut?

On November 7, 2005, CMS published foundation standards that became effective on January 1, 2006.  These standards apply to all electronic prescribing done under Part D of the MMA. The foundation standards cover:

  • Transactions between prescribers (who write prescriptions) and dispensers (who fill prescriptions) for new prescriptions; refill requests and responses; prescription change requests and responses; prescription cancellation, request and response; and related messaging and administrative transactions;
  • Eligibility and benefits queries and responses between prescribers and Part D sponsors;
  • Eligibility queries between dispensers and Part D sponsors.

MMA required CMS to implement pilot projects to test additional standards. These additional standards were pilot tested in 2006.  They are:

  • Formulary and benefit information
  • Prior authorization
  • Medication history
  • Structured and codified SIG
  • RxNorm


CCHIT Certification

Abulatory certification? Inpatient certification? What is it you need? Whatever it is you better start investigating your avenues now. Within 5 years the use of these types of software will not only be mandatory. But they will have been developed to the point that you won’t be able to operate without them. To many people will get left behind if the changes are not made starting today.
